Buying property through a family trust: what lenders check

07 October 2026

Holding property inside a family trust is usually a decision about tax, asset protection or succession, and the trust is often set up long before anyone thinks about finance. On a loan application, the structure matters. The borrower on paper is the trustee, and the people who control and benefit from the trust generally sit alongside the application as guarantors.

What the lender is reading

Credit policy for trust lending varies more than it does for a purchase in personal names. Common points of difference include:

  • The trust deed — whether it clearly permits the trustee to borrow and to give security over trust property.
  • Whether the trustee is an individual or a corporate trustee, and who sits behind that company.
  • Who the appointor and beneficiaries are, and whether any of them are companies or other trusts.
  • How trust income and distributions are read when the guarantors’ position is assessed.

Why timing matters

Trust applications call for more paperwork: a stamped copy of the deed, any deeds of variation, company documents for a corporate trustee, and identification for every party. Some lenders also refer the deed to their own legal team, which adds time. If a lender is not comfortable with the structure, the choice is to look for one that is, or to change the structure — and amending a deed or replacing a trustee is slow and can carry tax and legal consequences. That work sits better before a contract is signed than inside a finance clause.

Hi, I'm Jack Si from Australian Finance Service Solutions.

Buying property through a family trust changes who the lender is actually assessing. Some lenders look at the trust's structure, some look through to the guarantors, and not every lender is comfortable with every trust deed. Get the structure checked before you fall in love with a property.
